Terms and Conditions of Sale

Welcome to xabiersoubelet.com. These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between Xabier Soubelet and anyone making a purchase through this site. By confirming an order, you unreservedly accept these terms.

1. Seller Identification

The site is operated by:

2. Products

The offered artworks are unique pieces painted by Xabier Soubelet. Each piece is carefully described (dimensions, techniques, photos). Image colors may slightly differ depending on screens, which the buyer acknowledges and accepts.

3. Prices

Prices are displayed in euros, including all taxes (VAT). Shipping costs are not included in the displayed price and are specified during order validation.

4. Orders

To purchase an artwork, the buyer must:

  • select the desired piece and add it to the cart
  • fill in personal and delivery information
  • validate the payment via Woopayments

An order confirmation will be sent by email. Xabier Soubelet reserves the right to cancel an order in case of incorrect information or non-validated payment.

5. Payment

Payments are processed via Woopayments, a secure platform that accepts major credit cards. Payment data is not stored on xabiersoubelet.com.

6. Shipping

Artworks are shipped within 7 business days after payment validation. Delivery time may vary depending on the destination. Shipping costs and terms are specified during the order process.

In case of delays or issues with the carrier, Xabier Soubelet will assist with the necessary steps.

7. Withdrawal Rights and Returns

In accordance with Article L121-21-8 of the Consumer Code, the right of withdrawal does not apply to personalized or unique artworks. Therefore, items purchased on xabiersoubelet.com are neither refundable nor exchangeable.

Exceptions:
Returns are accepted only in the following cases:

  • the artwork was damaged during shipping
  • an error occurred in the preparation or shipment of the order

8. Remboursements

Si un retour est approuvé :

  • un remboursement partiel ou intégral sera effectué selon la situation
  • le remboursement sera crédité sur le mode de paiement initial dans un délai de 30 jours;

In these cases, you must contact us within 7 days of receiving the artwork, providing detailed photos of the item and its packaging.

9. Return Shipping

Return shipping costs are the responsibility of the buyer, except in cases of proven damage or error on our part. It is recommended to use a tracked service for high-value artworks. Xabier Soubelet will not be held responsible for loss or damage during return shipping.

10. Intellectual Property

All artworks, images, texts, and other content on xabiersoubelet.com are protected by copyright and remain the exclusive property of Xabier Soubelet. Any reproduction or use without written permission is strictly prohibited.

11. Liability

Xabier Soubelet shall not be held liable for damages resulting from the use of the site or the inability to access it, including loss of data or viruses.

12. Governing Law and Jurisdiction

These T&Cs are governed by French law. In case of a dispute, the competent courts of Bayonne shall have exclusive jurisdiction.
